YOKOHAMA TWS TRACTOR TYRES LOYALTY PROGRAMME
CUSTOMER/USER GENERAL TERMS AND CONDITIONS

ARTICLE 1: COMPANY INFORMATION

The Yokohama TWS tractor tyres loyalty programme (hereinafter known as the 'loyalty programme') was developed by Yokohama TWS S.p.A and is managed in New Zealand by TRS Tyre & Wheel Limited (with registered offices located at 1 Imlay Place, Wanganui, New Zealand).

ARTICLE 2: GENERAL DESCRIPTION OF THE PROGRAMME

Through the loyalty programme, customers who purchase new tractors fitted with Yokohama TWS tyres from authorised dealers can collect loyalty points based on the power of the engine of the purchased tractor. Depending on the number of points collected, beneficiaries can exchange their points in return for various rewards.

ARTICLE 3: TERMS AND CONDITIONS TO BE ELIGIBLE FOR THE PROGRAMME

Only customers who purchase new tractors fitted with Yokohama TWS tyres from authorised dealers and who purchase new Trelleborg tyres are eligible to enjoy the benefits of the loyalty programme. Tyre sizing and models’ limits apply.
Purchasing a new tractor fitted with Trelleborg tyres from authorised dealers or purchasing new Trelleborg tyres from the tyre dealers as specified above entails the unconditional acceptance of these terms and conditions and any amendments to these general terms and conditions that may be made at any time over the course of the loyalty programme.

ARTICLE 4: EARNING POINTS AND VALIDITY PERIOD

On the purchase of a new tractor with over 100 horsepower fitted with Trelleborg tyres, the act of purchase will be recorded by the dealer. Once the act of purchase has been recorded, loyalty points are assigned to each beneficiary, based on the engine power of the purchased tractor fitted with Trelleborg tyres, according to the following scheme: 1 horsepower = 2 points. On the hire of a tractor, no loyalty points are assigned.
On the purchase of new Trelleborg Tyres as above, the customer shall record its purchase on the web portal and then the loyalty points shall be assigned to the beneficiary according to the following scheme: for tyres <=30 inch = 160 points, for tyres >30 inch = 320 points.
Points collected under the loyalty programme have no market value, and cannot be exchanged under any circumstances for cash, transferred or sold to third parties.
The loyalty points earned will be valid and can be used until 31 December 2024. If the loyalty point balance is not used within the given time frame, the points will be irretrievably lost.

ARTICLE 5: CHECKING LOYALTY POINT TOTAL DETAILS

Beneficiaries of the programme can check their loyalty point total on the website nz.agriplus.trelleborg-tires.com
Any claims relating to loyalty point balances must be made to Yokohama TWS using the contact form provided on the website, nz.agriplus.trelleborg-tires.com

ARTICLE 6: REWARDS

The rewards available, as well as their value in points, are listed in the catalogue which can be found on the web portal dedicated to the campaign.
Yokohama TWS reserves the right to amend the list of rewards available at any time, as well as the number of points required to obtain these rewards, without this constituting ground for any claim to be brought against it.
The information presented on the web portal shall not be construed as constituting a proposition of sale or purchase.
Obtaining the rewards is subject to the conditions set out in these general terms and conditions and the reward store terms and conditions available at rewards.agriplus.trelleborg-tires.com/termsandconditions.

ARTICLE 7: EXCHANGING POINTS

Beneficiaries of the loyalty programme can order one or more rewards on the website, nz.agriplus.trelleborg-tires.com using all or part of the points that they have available.
The number of points corresponding to the order will be deducted from their point total as soon as the point exchange request has been placed.
Delivery is made by post to the address provided when placing the order. Deliveries cannot be made outside of New Zealand.
Yokohama TWS shall not be held liable for any delay, loss, damage, or harm in the event of delay or issues with postal services.
No disputes or claims for cash refunds, exchanges, or compensation of any kind whatsoever may be filed against Yokohama TWS for the rewards. Any claims relating to the rewards must be sent directly to the suppliers of the goods listed on the programme's web portal in accordance with the conditions set out in the terms and conditions provided on the rewards presented on the website, nz.agriplus.trelleborg-tires.com, and which beneficiaries will have been asked to read prior to ordering their reward.

ARTICLE 8: MEMBER OBLIGATIONS

8.1 Credentials

Beneficiaries shall undertake not to share their credentials (username and password). The use of these credentials constitutes proof of the identity of beneficiaries.
Beneficiaries shall use these credentials at their own risk and peril. Beneficiaries are responsible for maintaining the confidentiality of their password to prevent any unauthorised access to their loyalty points account.

8.2 Use of the web portal

Beneficiaries shall undertake not to:

  • misuse or make unlawful use of the web portal;
  • attempt to interfere with the web portal or to access said portal using a method other than the interface and the instructions provided by Yokohama TWS.

ARTICLE 9: CHANGES TO THE PROGRAMME/INACTIVE LOYALTY POINTS ACCOUNTS

Yokohama TWS reserves the right to modify, suspend or definitively terminate all or part of the loyalty programme at any time, without compensation of any kind whatsoever.
In the event that the loyalty programme is closed, beneficiaries will have 15 days from the closure notice published on the web portal by Yokohama TWS to exchange their points for rewards. Any points remaining in the account once this 15-day period has elapsed will be irretrievably lost.

ARTICLE 10: INTELLECTUAL PROPERTY

These general terms and conditions do not confer the right to use, reproduce, distribute, adapt, modify, publish or communicate the trademarks, logos or any other aspects presented on the web portal which may be protected under intellectual property rights.
Beneficiaries are solely granted a non-exclusive, revocable, non-transferable and limited licence to access, use and display the web portal.

ARTICLE 11: DATA PROTECTION

When subscribing as a member and over the course of the programme, personal information collected as part of the programme shall be processed in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation).
Beneficiaries are informed that they may receive business solicitations via email in connection with complete tyre and wheel lines for agricultural and forestry machines, forklift trucks and other handling equipment, including in the form of information bulletins and information about the programme. As regards the email addresses of natural persons, beneficiaries may expressly oppose these business solicitations.
All beneficiaries have the right to access, oppose and rectify their personal information. Any request to access, rectify or oppose data must be made using the contact form provided on the website, nz.agriplus.trelleborg-tires.com

ARTICLE 12: LIMITATION OF LIABILITY CLAUSE

Yokohama TWS shall not be held liable for the conformity or functioning of the rewards granted. Beneficiaries acknowledge and accept that Trelleborg cannot be held liable, in any manner whatsoever, for any direct and/or indirect damages, be these material or non-material, no matter the cause, origin, nature or consequences which may arise as a result of using the rewards granted.
Yokohama TWS cannot be held liable for any delay in delivery or non-delivery.
Yokohama TWS shall not be liable for any damage that may be caused to beneficiaries' computer hardware after accessing or using the web portal.
The unavailability of the web portal, even if for a prolonged period of time and of no limited duration, cannot be constitutive of injury to beneficiaries and under no circumstances shall this give rise to a claim for damages against Yokohama TWS.

ARTICLE 13: SERVICE PROVIDER

In the event of delay in delivery or non-delivery, beneficiaries can contact the rewards supplier directly. However, beneficiaries can also use the contact us form available at rewards.agriplus.trelleborg-tires.com/rexContact to get in touch with our customer services.
Any reward request placed by beneficiaries implies full and unconditional acceptance of these terms and conditions.

ARTICLE 14: SEVERABILITY

If one or more provisions of these general terms and conditions are unenforceable or declared as such in application of a law or regulation, or as a result of the final decision of a competent court, all other provisions shall remain fully valid and in force. As such, provisions declared unenforceable and invalid shall be replaced by provisions that most resemble the contents of the provisions that were originally terminated.

ARTICLE 15: ALLOCATION OF JURISDICTION

These general terms and conditions are governed by and interpreted and applied in accordance with English law.
Yokohama and the beneficiaries shall comply with all data protection laws, regulations and policies, including but not limited to the Privacy Policy.
Any dispute arising from these terms and conditions of use, in the event that an amicable agreement cannot be reached, shall be referred to the competent courts within the jurisdiction of the head offices of TRS Tyre & Wheel Limited.
